These terms apply to all quotes, orders and services provided by RMC Promotions, a business of Ruby Moon Co LLC ("RMC Promotions," "we," "us"), and to your use of this website. Because promotional and custom products are made to order, please read them carefully. By approving a quote or proof, placing an order or making a payment, you agree to these terms.

1. Quotes, deposits and payment

  • Quotes are estimates based on the products, quantities, decoration and timing described, and remain valid for the period stated on the quote. Prices may change if the details, quantities or supplier pricing change.
  • A deposit may be required before we place an order, and custom orders are not scheduled for production until the deposit and any required approvals are received.
  • The balance is due by the deadline stated on your quote or invoice, and before shipment or delivery unless we have agreed otherwise in writing.
  • Late payments may delay or pause your order and may be subject to a late fee or interest where permitted by law. Prices do not include shipping, taxes, setup, rush or other fees unless stated.

2. Artwork, proofs and approvals

  • We will send a proof showing the artwork, logo, colors, text and placement for your review. Please check every detail carefully, including spelling, names, dates, numbers and colors.
  • Once you approve a proof in writing, including by email or text, you are responsible for any errors in the approved content, and we are not responsible for mistakes that were present in the approved proof.
  • Colors may vary slightly between screens, proofs and finished products, and between production runs and materials. Ink, thread, engraving and decoration colors are matched as closely as the process allows.

3. Production, shipping and delays

  • Production and delivery times are estimates that begin once payment and final proof approval are received. They are not guarantees.
  • We are not responsible for delays caused by suppliers, backorders, carriers, weather or other events outside our control. We will tell you promptly if we learn of a delay and will work with you on options.
  • If a product is unavailable or backordered, we may suggest a comparable substitute, which you may accept or decline. Industry-standard overruns or underruns on custom orders, commonly up to 10 percent, may apply and be billed or credited accordingly.
  • Risk of loss passes to you when the order is handed to the carrier. Please inspect your order on arrival and tell us about any damage or shortage within 5 business days of delivery.

4. Cancellations, returns and refunds

  • Custom and personalized items are made specifically for you and generally cannot be returned, exchanged or refunded, because they usually cannot be resold.
  • Once an order has been approved or production has started, it cannot be cancelled, and deposits and costs already incurred are non-refundable. A request to cancel before production begins is handled case by case, and you remain responsible for non-refundable costs already incurred.
  • If we make an error that does not match your approved proof, or if an item arrives defective or damaged, tell us within 5 business days of delivery and we will repair, reproduce or credit the affected items, at our option.

5. Customer-supplied artwork and trademark permissions

  • You are responsible for the artwork, logos, text, names and other materials you supply, and you confirm that you own them or have permission to use and reproduce them.
  • We may decline or stop any job that we believe infringes a trademark, copyright or other right, or that is unlawful or inappropriate. If you ask us to reproduce a third party's brand or logo, you are responsible for having the owner's permission.
  • You agree to defend and hold RMC Promotions harmless from claims arising from materials you supply.
  • We may photograph or video finished work for our portfolio unless you tell us in writing that you do not want us to. We will not publish your artwork in a way that identifies you if you ask us not to.

6. Warranties and limits of liability

  • We pass through any manufacturer warranties on the products we supply. Except as stated in these terms, and to the extent permitted by law, products and services are provided "as is" without other warranties, express or implied.
  • To the fullest extent permitted by law, RMC Promotions is not liable for indirect, incidental, special or consequential damages, including lost profits or lost event opportunities, and our total liability for any claim is limited to the amount you paid us for the order at issue.
  • Nothing in these terms limits any right you have under consumer protection or other laws that cannot be waived or limited by agreement. Some places do not allow certain limits, so parts of this section may not apply to you.

7. Website use

Content on this website is provided for general information and may change without notice. Photos show examples of past work, and individual products, colors and availability can differ. The website and its content belong to RMC Promotions and Ruby Moon Co LLC and may not be copied or reused without permission.

8. General

These terms, together with your signed or approved quote, proof and invoice, are the entire agreement between us for your order. If any part is unenforceable, the rest stays in effect. These terms are governed by the laws of the State of Texas. We may update these terms, and the version in effect when you place your order applies to that order.
